The UPC has been busy since its doors opened in June 2023, with more than 60 infringement actions and more than 25 revocation actions. There have also been over 100 orders and decisions.
As expected, a significant number of opt-outs have been registered while patentees wait to see the outcome of the initial UPC decisions. There have been a significant number of requests for UPs, with many patentees wishing to take advantage of the cost savings associated with the UP for coverage in 17 countries.
Significantly, English is quickly becoming the main language of the UPC.
The Court has also been praised for its efficiency and speed of making decisions, even in complex cases, and its value for money.
The proceedings a significantly frontloaded and mainly in writing, which is similar to the EPO opposition process. Our Forresters UPC representatives have significant experience in handling EPO opposition proceedings, and so is well placed to handle UPC proceedings.
