Unified Patent Court expected “early 2023”

Preparations for the Unified Patent Court (UPC) are continuing with the latest prediction for its start date falling in the “last quarter of 2022 or early 2023”. Although Alexander Ramsay, chairman of the UPC’s Administrative Committee, has informally indicated that Q1 2023 is now the earliest expected start date.
Candidates for the positions as judges of the Court have been interviewed and appointments are due to be made before summer. Training of the judges can then take place and they can elect the two Presidents of the Court.
Once the court is ready, Germany will deposit its instrument of ratification of the UPC Agreement. The UPC will start from the date of entry into force of the UPC Agreement. This will be on the first day of the fourth month after Germany’s deposit.
