{"id":7689,"date":"2026-01-20T10:57:08","date_gmt":"2026-01-20T10:57:08","guid":{"rendered":"https:\/\/forresters-ip.com\/?p=7689"},"modified":"2026-01-23T09:41:43","modified_gmt":"2026-01-23T09:41:43","slug":"triton-showers-overcomes-patent-infringement-action-at-the-court-of-appeal","status":"publish","type":"post","link":"https:\/\/forresters-ip.com\/de\/triton-showers-overcomes-patent-infringement-action-at-the-court-of-appeal\/","title":{"rendered":"Triton Showers overcomes patent infringement action at the Court of Appeal"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Norcros&nbsp;Group (Holdings) Limited (Triton Showers) appealed the decision of the Intellectual Property Enterprise Court that found Kohler Mira&#8217;s patent to be valid and infringed by Triton&#8217;s DuElec\u00ae range of dual outlet electric shower products.&nbsp;Triton won the appeal on both counts in a judgement handed down on 22 December 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of Appeal <a href=\"https:\/\/url41.mailanyone.net\/scanner?m=1vgQLp-000000001ST-2rPQ&amp;d=4%7Cmail%2F90%2F1768494600%2F1vgQLp-000000001ST-2rPQ%7Cin41q%7C57e1b682%7C10471804%7C16773487%7C696917D11D7F6DDB47A41C2685E72DD2&amp;o=%2Fphta%3A%2Fctsaasei.ntlwhlonvrciaauges%2Fv.k.ovaew2ci%2Fc%2F0%2F02c67%3F51ctou%25ewar%3DvicF2&amp;s=3UtfxHf-3FOAPe5dBM3uv1aVvH0\">ruled<\/a> that the patent was invalid for insufficiency because the boundary of the claims was uncertain to the point of being &#8222;impossible to determine&#8220;.&nbsp;Regardless of the validity of the patent, the Court of Appeal also held that Triton&#8217;s products did not infringe the claims either on normal interpretation or under the Doctrine of Equivalents.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Triton has thus sealed a decisive victory and continues to be free to sell its DuElec\u00ae range of products, which continue to be highly successful and well regarded in the shower market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Forresters partners, <a href=\"https:\/\/forresters-ip.com\/de\/people\/matthew-shaw\/\">Matthew Shaw<\/a> and <a href=\"https:\/\/forresters-ip.com\/de\/people\/dr-jagvir-purewal\/\">Jagvir Purewal<\/a>, and Senior Associate, <a href=\"https:\/\/forresters-ip.com\/de\/people\/greg-smith\/\">Greg Smith<\/a>, provided support to Triton and their litigation team throughout the dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jagvir commented:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThis decision from The Court of Appeal has shown that both Triton Showers\u2019 and our conviction that this patent was invalid and not infringed was right all along.
